Terms and Conditions

 

These general terms and conditions are intended to regulate the terms and conditions governing the Online Store of Soares & Simões Lda. – with registered office at Rua António Figueiredo, nº1261, 3754-901 Águeda, Portugal, under the single registration and legal entity identification number 502175672, hereinafter referred to as Soares & Simões. The service consists of providing, through the address www.soaressimoes.com, access to the online store which, in addition to providing information regarding a range of products and/or services, allows users to electronically order the products advertised therein, under the terms and conditions described herein. These general terms and conditions and all disputes arising from or relating to these general terms and conditions shall be governed by Portuguese law.

1. Terms and Conditions of Sale

Prices are valid except in the event of a typographical error.
Promotions are subject to available stock.
In the event of a stock shortage, Soares & Simões reserves the right to replace the out-of-stock product with an equivalent product, in order to ensure customer satisfaction.
VAT included at the applicable legal rate.
Accessories and assembly are not included.
The prices shown do not include any shipping/delivery costs. The cost of the applicable shipping/delivery service will be calculated according to the geographical area and the corresponding weight of the order.

2. Returns/Refunds

Under its commercial policy, Soares & Simões Lda. guarantees a refund of the purchase amount, provided that the customer meets the following requirements:
a. The return is made within 14 days of purchasing the item;
b. The customer presents the invoice;
c. The customer presents the item properly packaged, with all its components and accessories, and in perfect condition.

Notwithstanding the conditions referred to above, in accordance with Decree-Law No. 24/2014 of 14 February, Article 12, within 14 days following receipt of the product(s) purchased on our website, the customer may, without any penalty or need for justification, exercise their right of withdrawal from the contract, under the terms legally provided for.

For returns after delivery, the customer must contact the company’s Customer Service department by calling 234 600 830.

In the event of the return of a product purchased from the online store, under the terms and conditions set out above, Soares & Simões, Lda. will refund the customer the amount corresponding to the purchased items within a maximum period of 14 days following the return and using the same payment method used by the customer at the time of purchase.

3. Delivery Times

3.1 The estimated delivery time for the different delivery methods begins from the moment payment is received. In the case of Mainland Portugal, orders are normally delivered within 20 business days (subject to the availability of all items included in the order).

3.2 Soares & Simões Lda. shall not be liable for any failure to fulfil, or delay in fulfilling, any obligation where such failure or delay is due to an event of force majeure, that is, an event beyond its reasonable control.

3.3 Whenever possible, we will attempt to deliver the entire order in a single shipment. However, we reserve the right to split the delivery of an order. If we proceed with splitting the order, the customer will be notified by email or telephone of our intention to do so. For this purpose, the email address or telephone contact details provided by the customer at the time of purchase will be used.

3.4 A specific delivery time cannot be scheduled due to reasons related to the organisation of transportation and unforeseen circumstances that occur daily along the drivers’ routes. Our logistics service will contact the customer using the details provided in the customer record in order to confirm the delivery date and the estimated delivery time period.
